This Disclaimer & Refund Policy (“Policy”) applies to prepaid balances, minute bundles, and account top-ups purchased from Fortress Data Management Solutions (“Fortress,” “we,” “us,” or “our”), including the Trial Top-Off ($10–$100) and the Bulk Minutes Top-Up.
1. Prepaid balances are non-refundable
All account top-ups — including Trial Top-Off credit and Bulk Minutes Top-Up bundles — are sold as prepaid balances. Except where a refund is required by applicable law, prepaid balances and prepaid minutes are non-refundable once purchased, whether or not the credit or minutes have been used. Prepaid credit has no cash value and cannot be redeemed for cash.
2. Rollover and expiration
Where a plan provides for rollover (for example, the Basic plan’s 500 monthly minutes), unused minutes carry forward on renewal as described on the applicable product page. Rollover is contingent on your account remaining active and in good standing. We reserve the right to expire or forfeit unused balances upon account closure, non-payment, or termination for cause, subject to applicable law.
3. No guarantee of uninterrupted service
Fortress provides its calling, messaging, and platform services on an “as is” and “as available” basis. We do not warrant that the service will be uninterrupted, error-free, secure, or free from delays, and we are not liable for service interruptions arising from carrier networks, third-party providers, maintenance, force majeure, or circumstances beyond our reasonable control. Purchasing a prepaid balance does not guarantee availability of any particular feature, capacity, or call quality.
4. Prices subject to change
Subscription fees, add-on fees, per-minute rates, and top-up bundle pricing are subject to change at any time without notice, except as otherwise required by an active written agreement. Introductory or promotional pricing may be time-limited. Changes to recurring fees will apply on your next billing cycle.
5. Billing authorization
By purchasing a top-up or subscription you authorize Fortress (and its payment processors) to charge your selected payment method for the amount presented at checkout, including any applicable taxes and regulatory fees. Metered usage is debited from your prepaid balance at the then-current per-minute rate.
6. Chargebacks and disputes
If you believe you have been charged in error, please contact us before initiating a chargeback so we can resolve the matter. Fraudulent chargebacks may result in suspension of service.
7. Governing law
This Policy and any dispute arising out of or relating to it are governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles. Nothing in this Policy limits any non-waivable rights you may have under applicable law.
